Gondûzô-Alkonyat Mudi Kennel Limited Warranty
For Mudi puppies placed after January 2010
(puppy/dog are interchangeable terms for the Mudi puppy/dog that was taken
from the Breeder’s home and placed with the original Owner)

This section is valid as of January 2004 for all Gondûzô-Alkonyat pups
Documentation and Parentage Guarantees
  • We guarantee the parents (sire and dam) of our puppies are the ones listed on their pedigree, we will supply DNA samples when required and as available (we cannot guarantee testing permission on dogs we do not own or have died); all testing is to be done at the requester’s expense.
  • We guarantee that the pedigrees for our owned dogs and the puppies we pedigree are genuine, official FCI associated member organization pedigrees, issued from the MEOE (Hungarian Kennel Club) in Hungary – they are not forgeries or unregistered documents.
  • We guarantee that the health, herding instinct, temperament test and breeding exam documents, as well as all show/sport/performance event results, placements and titles, are official and genuine and issued from the association listed on the document.

This section is valid for Gondûzô-Alkonyat puppies placed after January 2010
Health at Time of Placement
  • The Breeder guarantees the puppy to be in good health and of sound temperament at that time that it leaves our home.
  • The Owner agrees to take the puppy to a licensed veterinarian of their choice within 72 hours of arriving home for a health check at their expense.
  • The puppy is guaranteed to be free of major communicable diseases (these are: distemper, hepatitis, leptospirosis and rabies) for a period of seven (7) days from the date of sale.
  • Should the puppy be determined to be in ill health from distemper, hepatitis, leptospirosis or rabies disease within 7 days after leaving our home, the cause of which is clearly attributable to the Breeder, the puppy may, upon presentation of a written diagnosis and supporting documentation from a licensed veterinarian, be returned to the Breeder for replacement only. All registration paperwork showing proper transfer of ownership back to the Breeder, as well as all other documentation that belongs to the puppy (i.e., Pedigree, EU Passport, contract, etc.) must accompany the returned puppy.  All shipping costs to return the puppy to the breeder are the responsibility of the owner.

Genetic Health Warranty
  • The puppy is warranted against only serious, genetically caused joint defects known as hip and elbow dysplasia that are proven with internationally recognized orthopedic organization results which are considered failed in Hungary, that is Közepes/D or Súlyos/E, until the age of twenty-five (25) months provided it was not kenneled solely outside, kept on concrete or other hard surfaces, fed only an approved raw/homecooked diet (not commercially manufactured kibble/canned food) from the time it has left our home, has been properly and suitably exercised and trained (neither over, nor under), not overweight at any time prior to this age and given appropriate and required veterinarian care till this time.  Proof of all care documentation is to be provided by the purchaser to the seller.
  • Patellas are NOT guaranteed due to their inherent ability to suffer injury.
  • For the purpose of evaluation for hip and elbow dysplasia, the Owner agrees to submit hip and elbow x-ray films showing proper positioning and meeting accepted standards to an internationally recognized orthopedic organization such as OFA (USA) or MKOE (Hungary), once the puppy is old enough to be eligible for certification. (Please note: different organizations have different minimum age requirements, but the maximum age the dog must be tested by is twenty-five (25) months, unless a bitch is verified by a vet to be in season which can delay the checking for one month to twenty-six (26) months of age.) This evaluation is done at the Owners expense. The opinion of a veterinarian and preliminary evaluations, such as are provided by OFA for dogs under 2 years old, are not acceptable as proof of a defect.
  • Should the dog fail to certify and be evaluated as seriously dysplastic in hips or elbows by an internationally recognized orthopedic certification organization, a copy of the original x-ray must be sent to the Breeder, and must include on the x-ray plate the date that the x-ray was taken and the ID information (microchip number must be embedded on the X-ray film) of the dog. The Breeder must also be provided with a current, dated photograph of the dog, and a written statement from the veterinarian who took the x-ray stating the weight of the dog at the time the x-ray was taken and that, to the veterinarian’s knowledge, any joint pathology present is not due to injury, weight or keeping concerns. No replacement will be made without an official evaluation and other supporting documentation.
  • Eyes are guaranteed against only those genetic diseases (these are: PRA, CEA and Cataracts) which will cause blindness in the dog before eight (8) years of age. Disease and blindness which occurs after age eight (8) for any reason is not covered under this warranty. An eye exam by a qualified veterinary ophthalmologist in the Owner’s country (CERF approved vet USA, Dr. Szentgáli in Hungary, etc.) must be performed every year, starting at one (1) year of age of the puppy and a copy must be mailed to the Breeder immediately after each of these exams or to the CERF registry for recording on their website.  If a positive diagnosis is made, the Owner must have another qualified eye exam performed at their expense at a vet the Breeder requests to support the original diagnosis before a replacement can be made. Copies and photographs of the eye/s may also be requested for submission to the Breeder’s eye vet in Hungary also at the Owners expense.
  • The puppy is warranted against genetic epilepsy up to the age of five (5) only.  Should the puppy develop epilepsy from any cause after the age of five (5) no warranty is given.  Should the puppy develop genetic epilepsy prior to five (5) years of age, two veterinarians, one of which must be an expert/specialist in the field of epilepsy treatment and diagnosis, must officially verify the cause of the epilepsy is genetic in writing and all the testing procedures required to make such a diagnosis must be performed and copies of all documents, tests, reports, etc., must be provided to the Breeder.  Additional documentation in the form of video recording of the puppy having seizures may also be required, as well as any other proof of diagnosis deemed necessary by the Breeder, before replacement will be considered.
  • Proof in the form of a written diagnosis and any supporting evidence (i.e. laboratory tests, x-rays) from a licensed veterinarian must be provided to the Breeder prior to replacement. The Breeder also reserves the right to contact the Owner’s veterinarian that has been treating the dog to inquire about past and present health conditions, injuries and other relevant information.
  • Any diagnosis made by the Owner’s veterinarian shall be subject to confirmation by a veterinarian chosen by the Breeder. Should the Breeder’s chosen veterinarian not concur with the diagnosis, the matter shall be presented to a third veterinarian mutually agreed upon by the Breeder and the Owner.
  • Should the dog be satisfactorily proven to have serious genetic hip/elbow dysplasia, genetic epilepsy or genetic eye disease covered under this Limited Warranty, the Owner shall:
    • Keep the original dog and receive a replacement dog from a future litter of equal or greater value, not necessarily from the same breeding. The Breeder must be provided with proof that the original dog has been spayed/neutered prior to issuing a replacement. All shipping costs are the responsibility of the Owner.
  • No other warranty or guarantee for any other genetic disease not listed above is given.

Physical Appearance Warranty
We do not offer any warranty for physical appearance faults (teeth, bite, testicles, ears, etc.) which may exclude a dog from breeding because we do not differentiate the cost or value of puppies based on purpose/intention of an Owner, we do not require at placement that any puppy is or is not bred as this is an individual Owner preference and ability, nor can we control breeding of any puppy and also because we do not have the capability to control physical appearance traits from appearing or not in any puppy.

Miscellaneous
  • Breeder shall not be held responsible for any non-genetically derived diseases or disorders, or for any health problems, regardless of nature, that are due to improper care and maintenance of the puppy/dog.
  • We make no temperament or performance warranty or guarantees as these are strictly Owner management dependent.
  • Should the puppy be bred before two (2) years of age, this Limited Warranty is void.
  • Should the puppy be bred before all health and temperament testing (testing includes: hip/elbow/patella scoring with an accepted international orthopedic organization such as OFA or MKOE; annual eye exam with international ophthalmological organization such as CERF, Dr. Szentgáli; temperament test performed and passed with a recognized canine organization) is completed, this Limited Warranty is void.
  • Should the Owner suspect the dog possesses any health related problems stated above and covered under this Limited Warranty, the Breeder must be notified immediately.
  • Should the puppy/dog develop any health, temperament or performance problems that are clearly attributable to abuse, neglect, injury, poor nutrition or factors that are not genetic in origin, such issues will not be covered under this Limited Warranty and the Breeder will be held harmless.
  • This is a Limited Liability Warranty. The Owner understands that under no circumstances will the Breeder be held responsible for monetary compensation.
  • Replacement credits do not include applicable shipping costs. The Owner is solely responsible for any applicable shipping costs on replacement dogs.
  • This Limited Warranty is between the Breeder and original Owner and is NOT transferable to a third party, family member, rescue association, etc.
  • There are no additional warranties, either intended or implied.
  • Future contract revisions, additions or corrections may or may not affect this contract.

Current version date:  January 28, 2010.
